1. Purpose and acceptance
These terms govern the use of the website hilbana.com and the subscription to and use of Hilbana, the project management service available at app.hilbana.com. By using the Site, creating an account or subscribing to a plan, you accept these terms, the Legal notice and the Privacy policy.
2. Accounts
To use the service you need an account with a valid email address, and you must be of legal age or acting on behalf of an organization with capacity to enter into this agreement. You are responsible for keeping your credentials confidential and for the activity carried out from your account. Let us know as soon as you detect any unauthorized use.
3. Plans, prices and taxes
The service is offered on a free plan and on paid subscription plans, with the prices and limits published on the pricing page. Prices are shown excluding VAT; applicable taxes are added to the invoice based on your tax status and country.
We may change our prices. Changes never affect a period already paid for, and we will tell you a reasonable time before the next renewal. Where a rate is offered as a founder price, it holds for as long as the subscription stays active without interruption.
4. Billing, renewal and cancellation
Paid plans are billed in advance and renew automatically for equal periods unless cancelled. Payment is processed through our payment provider; we do not store your card details.
You can cancel at any time from your account. Cancellation takes effect at the end of the current period: you keep access until then and no further charges are made. Except as set out in the following section, amounts for periods already started are non-refundable.
5. Right of withdrawal
If you subscribe as a consumer, you have fourteen calendar days to withdraw from the contract without giving a reason. As this is a digital service performed immediately, by subscribing you expressly request that performance begin right away and acknowledge that you will lose the right of withdrawal once the service has been fully performed. To exercise it, write to [email protected]. This section does not apply to businesses or professionals.
6. Acceptable use
You may not use the service for unlawful activities, to infringe the rights of others, to distribute malicious software, to attempt to access other people's workspaces, or to compromise the availability or security of the platform. Reselling or transferring it to third parties without our agreement is not allowed either.
7. Your content
The data and content you and your team create in the service remain yours. You grant us only the technical licence needed to host, process and display it in order to provide the service. You can export it at any time. You are responsible for that content being lawful and for holding the necessary rights over it.
8. Availability and support
We work to keep the service continuously available, but we do not guarantee uninterrupted or error-free operation. We may carry out maintenance and introduce changes to features. Support is provided by email at [email protected], during business hours, in Spanish or English.
9. Suspension and termination
We may suspend or terminate an account that breaches these terms, fails to pay a subscription, or puts the security of the service at risk, giving notice where possible. After termination you will have a reasonable period to export your data before it is deleted.
10. Liability
To the extent permitted by law, our liability arising from the use of the service is limited to the amount paid in the twelve months preceding the event giving rise to it, and does not extend to indirect damages or loss of profits. Nothing here excludes liability that cannot be limited by law, nor the rights that consumer regulations grant to consumers.
11. Intellectual property
The “Hilbana” brand, its logo, the software and all content on the Site are protected. No licence over them is granted by the mere use of the Site or the service.
12. Changes
We may update these terms. The version in force will always be the one published on this page, with its last-updated date. If a change is substantial and affects you as a customer, we will give you reasonable notice.
13. Applicable law
These terms are governed by Spanish law. Any dispute will be submitted to the courts of Pamplona (Spain), without prejudice to the rights that consumer regulations grant to users.
